Kan-Dapaah’s GH¢10m Defamation Case Against Barker-Vormawor Delayed

Former National Security Minister Albert Kan-Dapaah has suffered a setback in his long-running GH¢10 million defamation suit against activist Oliver Mawuse Barker-Vormawor, after the High Court postponed the delivery of judgment.

The Accra High Court, presided over by Justice Rev. Emmanuel Adu-Owusu Agyeman, had earlier fixed Tuesday, January 6, 2026, to deliver its ruling in the case.

However, when the parties appeared in court, the judge announced that although the judgment was ready, it could not be delivered because the date fell within the New Year judicial vacation.

Court Cites Judicial Vacation Rule

Explaining the decision, the court referenced Order 79 Rule 4(c) of CI 47, which governs the vacation periods of the Judiciary.

“The judgment of the court is ready, which is supposed to be read today, but my attention has been drawn to Order 79 Rule 4(c) of CI 47, which means that as of today, we are still on vacation,” the judge said.

He added that the court had erred in previously fixing the date for judgment.

“All of us were wrong at the time,” the judge remarked.

Counsel for the plaintiff, Lawyer Otchere Adjekum, reminded the court that the matter had been adjourned last year specifically for judgment delivery, a point the court acknowledged.

“This was the business of the day,” the judge noted, before concluding that judicial work could not proceed.

New Judgment Date Set

As a result, the court adjourned the case to March 2, 2026, for the delivery of judgment.

The postponement means Kan-Dapaah’s hope of seeing the case concluded this month has not materialised.

Background of the Case

Kan-Dapaah’s lawsuit stems from allegations made by Barker-Vormawor, a convener of the FixTheCountry Movement, who claimed that the then National Security Minister and other government officials had offered him $1 million to abandon his activism against the government.

The allegations were strongly denied by Kan-Dapaah, who subsequently filed a defamation suit against the activist.

Reliefs Sought by Kan-Dapaah

In his suit, the former minister is seeking:

  • GH¢10,000,000 in general damages, including aggravated and/or exemplary damages

  • A public apology and retraction of the alleged defamatory statements

  • A perpetual injunction restraining Barker-Vormawor from repeating similar statements
